Kenya / Certificate of Free Sale Information.

Prior to obtaining a conformity certificate for exports to Kenya, it was announced that a Free Sale Certificate, to be obtained from relevant organizations, must be presented to the authorized entities conducting pre-shipment inspections and the Kenya Customs Authority as per the regulatory amendment. This time, in reference to the letter registered under (b), it is stated that the Nairobi Embassy Trade Attaché has announced, in reference to a letter received from them, that the Kenya Bureau of Standards (KEBS) has published a new implementation guide on the matter.

In the guide, a sample of which is attached, it is stated that:

• Food products intended for human and animal consumption,

• Cosmetic and personal care products,

• Children's toys,

• Electrical and electronic products,

• Fertilizers and soil conditioners require a Free Sale Certificate.

Additionally, it is informed that the said certificate will be required if there is no Kenya standard, equivalent international standard, or national standard of the exporting country related to the product; if any of these standards exist, proving conformity through a conformity certificate issued under the pre-shipment inspection program will be sufficient instead of the Free Sale Certificate.
